AstroMarks Terms of Service

These Terms of Service ("Terms") govern your use of the AstroMarks application and related services (the "Service"). By using the Service, you agree to these Terms.

1. Service Scope

1.1 Entertainment and educational use

AstroMarks generates constellation-style visual matches from skin-feature annotations. The Service is intended for entertainment and educational use.

1.2 Not medical use

AstroMarks is not a medical device and does not provide diagnosis or treatment. See the Medical Disclaimer.

2. Eligibility and Accounts

You must be legally able to accept these Terms. You are responsible for account credentials and activity occurring under your account.

3. Purchases and Billing

Purchases may be processed by Apple App Store, Google Play, or Stripe. Billing disputes, refunds, and subscription management may be subject to the relevant platform's terms and policy workflows.

4. License to Use the App

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial use.

5. User Content and Consented Data License

5.1 Your ownership

You retain rights in content you submit, subject to the licenses below.

5.2 License for consented images

For images you explicitly consent to share, you grant AstroMarks a worldwide, royalty-free, sublicensable license to host, process, analyze, reproduce, modify, publish, and create derivative works from anonymized forms of that data only for the purposes you explicitly consented to in-app, unless we obtain additional consent from you for new purposes. This can include product development, research, and dataset licensing where those uses were selected in your consent settings.

6. Acceptable Use

You agree not to:

use the Service for unlawful or harmful activity;
attempt to reverse engineer or disrupt Service infrastructure;
upload content you do not have rights to provide;
misrepresent Service output as medical diagnosis.

7. Intellectual Property

The Service, software, branding, and related materials are owned by AstroMarks or its licensors and are protected by applicable intellectual-property law.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, AstroMarks and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or business arising from use of the Service.

10. Suspension and Termination

We may suspend or terminate access for violations of these Terms, abuse, or security risk. You may stop using the Service at any time.

11. Governing Law

These Terms are governed by the laws of New Zealand, subject to mandatory consumer-protection laws in your place of residence. Unless mandatory law requires otherwise, disputes will be resolved in the courts of New Zealand.
